Bellagio Limousines – Charter Booking Contract Terms and Conditions

 This is an agreement between the “Bill To:” party/hirer (you) as listed in the Customer Reservation Advice and Bellagio Limousines to hire the motor vehicle(s) described in the attached Customer Reservation Advice. The full terms and conditions of the reservation are listed below, and your payment of this agreement is deemed to be acceptance of the terms and conditions. You are fully responsible for this booking and for all passengers traveling in our vehicles. It is your responsibility for ensuring the terms and conditions are brought to the attention of all passengers. Only persons over the age of 18 years are able make a booking.

 

Payments/Cancellations

  1. When you, as the booking party pay the deposit to secure our services, it is deemed that you have read, understood and have accepted the Terms and Conditions of this agreement.
  2. No booking is confirmed until the Required Booking Fee/Deposit as detailed in your invoice has been received.
  3. If the total fee of the booking is less than $450, then the total fee is due immediately to secure your booking.
  4. The customer acknowledges that the booking deposit and any money paid to Bellagio Limousines, is not refundable, nor can it be transferred to another customer or another booking date.
  5. The customer agrees that full payment shall be made payable to Bellagio Limousines Ninety (90) days prior to the "Pickup Date" which is not refundable.
  6. If the booking is made within the 90 day period of the “Pickup Date”, then the full payment must be made within 24 hours of the ‘Booked on” date.
  7. Should you cancel your booking within 90 days of your pickup date, then you acknowledge that the total outstanding balance is due and payable immediately.
  8. Should you cancel or change your Pickup Date, any booking deposits or money paid, is not refundable.
  9. In the event where the Booking Deposit and Booking Balance is paid by cash, cheque or electronic bank transfer, credit card details of the booking person will be taken for any further charges specified in this agreements’ terms and conditions.

 

Overtime

  1. Overtime is subject to the availability of the vehicle and the chauffeur, and can only be approved by the office of Bellagio Limousines.
  2. Overtime is calculated and charged in 15 minute intervals. The overtime rate for the Chrysler Limousine is $115/15mins; for the Mercedes Sedan or Mercedes SUV $75/15mins; and for the Dodge Nitro $125/15min.
  3. The overtime fee will be debited to the customer’s credit card as per point #8.
  4. By entering into this agreement you authorise Bellagio Limousines to debit your credit card for any charges incurred by the terms and conditions in this agreement.
  5. In the event where the credit card as per point #8 needs to be debited, and the payment fails; you will be immediately contacted and given 3 days to make the payment. If the 3 days lapses and payment has not been made, the payment will be outsourced and legal action will commence, and incurred expenses will be worn by you.
 
Conditions of Travel
  1. Seatbelts - As per current legislation, all passengers must wear seatbelts while travelling in the vehicle.
  2. Vehicle Access - Due to the length of our Stretch Limousines, access into various suburban streets, ceremony and reception locations may be restricted; pickup/drop offs at front door may not be possible. The Chauffeur reserves the right to deny any access to any location that may put the vehicle and/or its passengers at risk.
  3. Vehicle Damage & Bad Behaviour - If you or any member of your party damage or soil the interior/exterior of our vehicle including all fittings and fixtures, you will be liable for all costs incurred to rectify the said damage.
  4. If you or any member of your party behave in a manner deemed rude, unsafe, crass or damaging or is considered intoxicated, before, after or whilst en route, we reserve the right to terminate your booking and evict you from the vehicle. No refund will apply.
  5. Alcohol - We do not offer alcohol as part of our service, and we will not be held responsible or liable for you or any part of your party consuming alcohol nor the consequences that may ensue. All alcohol consumption is your responsibility and at your own risk and you alone shall assume full liability. Any minor caught consuming alcohol while en-route in our limousine may be evicted from the limousine.
  6. Smoking is strictly prohibited in our vehicles and the consumption of any food is not permitted in the vehicle. 
  7. Unforeseen Circumstances - We cannot assume responsibility for any unforeseen circumstances beyond our control such as traffic, road and weather conditions, illness, vehicle breakdown etc. Should there be a vehicle breakdown or mishap rendering the reserved vehicle out of commission we reserve the right to substitute vehicle/vehicles. We will make every effort to supply a similar vehicle.
  8. Insurance - Our Insurance Policy covers all authorised persons travelling in the vehicle en route to their destination. Passengers assume personal liability when entering and exiting the vehicle. Bellagio Limousines accepts no responsibility for any loss, damage or theft of personal property.
  9. Limits of Liabilities - In all cases, Bellagio Limousines, owners, operators and chauffeurs/drivers maximum liability shall be limited to a full refund of monies paid pertaining only to the trip in question. All care will be taken by us, but no liability will be assumed. No claim for Liquidated Damages, Consequential Loss or for any other eventuality shall be admissible.
  10. Children over the age of 4 years old will be counted as an adult when travelling in the limousine. Children under the age of four are not permitted to travel in the limousine, unless prior arrangements have been with the office of Bellagio Limousines.
  11. The Maximum number of passengers allowed in our Dodge Nitro is restricted to 13 adults; Chrysler Limousine; 11 adults; 4 Adults in the Mercedes; and 6 Adults in the Mercedes SUV.
  12. If you have made a “Package Booking” and if you have received a discount, the discount will be honoured. If you cancel any portion of the said package booking, you acknowledge that you will forfeit the discount offered in this agreement.
  13. If you have booked the DJ and Limousine Services with Bellagio Limousines, and if you have received a “Discount”, the discount will be honoured. If you cancel the DJ or Limousne services, you acknowledge that you will forfeit the discount offered in this agreement.
 
Acknowledgement and Acceptance
By making your payment to Bellagio Limousines, you acknowledge that you read, understood and accepted the above terms and conditions of the above agreement.
